Senate Bill 862 was signed into law on June 14Th, 2000 by Governor Ben Cayetano. This law removes criminal penalties on the cultivation, use, and possession at the state-level by people who have received a signed recommendation from a qualified physician that affirms the fact that he/she suffers from some form of a debilitating illness or condition and that the “potential benefits of medical use of marijuana would likely outweigh the health risks.” Illnesses that qualify for a medicinal marijuana card in Hawaii include: Chron’s Disease, Multiple Sclerosis, Glaucoma, HIV/Aids, Cancer, chronic pain, debilitating conditions, as an alternative to other more addictive and harmful medical treatments. Other illnesses must be approved by the Hawaiian Department of Health.

To become a registered patient in the State of Hawaii please follow these steps: First and foremost you must be a resident of the state of Hawaii and provide a current Hawaiian I.D. as proof of residence. In the case you don’t have a Hawaiian I.D., passports, out of state I.D.s, or other photo I.D.s along with some form of proof of residency such as a utility bill, or bank statement, etc. is also acceptable. Next obtain your medical records and other related documents from your primary family physician. You must then bring these records with you to your medical marijuana evaluation appointment. As well as have the physician request, and fill out, the written certification form that can be obtained from the NED aka the Hawaiian Narcotics Enforcement Division who will then issue you your State of Hawaii medical marijuana card. The fee is currently $25 and your medical marijuana card will be valid for one year from date of registration. Qualified patients or their primary caregivers may possess up to three ounces of usable marijuana at one time. Also patient/cargiver may cultivate up to seven plants at one time but no more than three may be mature at any given time. Caregivers are allowed under the Hawaiian provisions. The definition of a caregiver is someone whom is responsible for managing the well-being of any given qualified patient in regards to the medicinal useage of marijuana. The caregiver is a someone other than the qualified patient, or the patient’s physician. The primary caregiver shall be at least 18 years of age or older. Qualified patients may have only one caregiver an any given time. As well as said caregiver may only be responsible for care of one qualifying patient at any given time. Haw. Rev.
